Likely Changes to Flexible Working Rights

The outcomes of the Government’s 2021 consultation on flexible working legislation were published earlier today and we’re likely to see a number of changes to current legislation. The timescale for the changes is unclear, but employment law normally changes in April or October.
The right to request flexible working from day one of employment; currently there’s a minimum service requirement of 26 weeks.
Employees will be able to make two requests in a twelve month period; currently it’s only one.
Employers will be required to discuss what flexible working arrangements may work for them, where the original request isn’t agreed; this isn’t a requirement currently but we always encourage our clients to do this.
